Madeleine McCann: A new twist in the case?

Media in the United Kingdom and the European Union are reporting this morning that the parents of missing British toddler Madeleine McCann have been declared suspects in their daughter’s disappearance. Kate and Gerry McCann may be arrested as early as today.

Intrepid journalist Paulo Reis, who has been covering the McCann disappearance in minute detail since Madeleine vanished, stated baldly in his blog/online paper, Gazeta Digital: “KATE McCANN COULD BE CHARGE [sic] TODAY IN CONNECTION WITH MADELEINE’S DISAPPEARENCE [sic].”

Madeleine, age 4, was allegedly asleep in an apartment with her younger brother and sister while her parents dined several yards away on May 3, 2007 in Praia da Luz, in southwestern Portugal.

Documenting all the twists and turns in the investigation into Madeleine’s vanishing from Praia da Luz last May would require a separate weblog. There have been suspects aplenty and sightings of the child all across the European Union. Madeleine’s physician parents, Kate and Gerry McCann, have become grim celebrities, with the ear of no less than British Prime Minister Gordon Brown (until recently that is, when it appeared as though Brown may have put some distance between himself and the couple). Multiple websites and personal profiles have been created by Americans, Britons, and Europeans alike. Message board and blog comment threads have been filled with speculation and painstaking analysis of every aspect of the truly troubling disappearance of the toddler from Leicester. In the last few days, suspicion of the missing child’s parents has increased as the McCanns found themselves under heavy questioning by Portugal’s criminal investigation outfit, the Polícia Judiciária, or PJ. Early in the search for Madeleine the McCanns were naturally subject to suspicion, but by late July much of the public focus had turned away from the parents and towards some sketchy characters living near Praia da Luz at the time of the child’s disappearance.

Early today, a Portuguese language paper, Sol, reported that there was “fortes possibilidades” — a strong possibility — of Kate McCann becoming “arguida” — a suspect in her daughter’s disappearance, presumably in Madeleine’s death.

In a statement to news services such as Reuters and the AP, McCann family spokesperson David Hughes said that during Kate McCann’s continued questioning by the PJ she would no longer be done as a witness but a suspect, or “arguida.” The status of “arguida” is not quite as serious as the designation “suspect” might be in the UK or the United States. U.S. authorities, for instance, have become quite careful in the last decade or so about calling someone a suspect — many people accused of crimes have remained simply “persons of interest” right up to the moment they were in handcuffs. In Portugal, “arguida” is a legal designation that permits deeper questioning of the person under interrogation.

Fine distinctions between the meanings of “arguida” and “suspect” notwithstanding, the world press has seized on this development as a truly shocking turn of events. The McCann investigation was initially all but ignored by the American press, even as it was becoming a tremendously high-profile case across the Atlantic. The traditional media here in America are all over the story today.

Are the PJ out of other suspects and simply reverting to the most likely culprits? Statistically, harm is most often done to children by a caretaker or someone close to them. When some, including bloggers posting here at CrimeBlog.US, were hesitant to express too much suspicion of the McCanns, commentators frequently expressed the feeling that the couple was being cut too much slack.

It may be that there is forensic evidence pointing towards the McCanns, evidence that has only recently become available. This report from Reuters contained statements from another friend and spokesperson for the McCanns, Justine McGuinness:

“She will formally be declared a suspect,” said Justine McGuinness, a spokeswoman for the McCanns. “Kate knows it’s possible that she could get arrested.”

McGuinness said McCann had told her that police found blood in a car hired by her and her husband, Gerry, but there was no confirmation it was Madeleine’s blood. The car had been hired 25 days after Madeleine disappeared.

“They believe they have evidence to show in some way that she is involved in the death of her daughter, which of course is completely ludicrous,” McGuinness told BBC television.

If the McCanns are arrested in connection with their daughter’s mysterious disappearance, it will truly be an amazing turn of events. Kate and Gerry McCann haven’t just had the ear of the British Prime Minister, they’ve spoken to Pope Benedict XVI as well as sympathetic celebrities in Europe and the U.S.

After the initial outcry against their perceived lapse in leaving Madeleine and her siblings alone on May 3, public perception of the couple grew steadily more sympathetic. They became more comfortable as well, making multiple high-profile public statements. Gerry McCann even began to blog at FindMadeleine.com. His entry from September 6, 2007:

Everyone will know that Kate attended for interview as a witness with the Portuguese police today. This is only the second time Kate has been interviewed and although it was a long day, going on past midnight, this was shorter than my second interview which lasted 13 hours! The suggestion that Kate is involved in Madeleines disappearance is ludicrous. Anyone who knows anything about the 3rd May knows that Kate is completely innocent. We will fight this all the way and we will not stop looking for Madeleine.

Admittedly, there had been a strangely blasé tone to many of Gerry’s previous blog entries. He still sounded at times like a man on holiday. Gerry’s entry from September 4:

Day 123 - 03/09/2007

After dropping the twins off Kate and I popped into church for 10 minutes to pray for Madeleine. Spent most of the day going through mail, e-mails and I had a number of calls to make. It was good to spend some time with my family and Sean and Amelie certainly enjoyed their auntie’s dinner- sometimes it is hard to beat mince and ‘tatties’!

A bereft father struggling to keep his fear and anxiety at bay, or a tone-deaf narcissist unable to perceive the shallow nature of such a statement? There seemed to be an inappropriate, perfunctory, almost business-like tone to the post quoted above: Dropped off the kids, check — prayed for the missing kid, check — sorted mail, e-mail, phone calls, etc…. another day at the office.

The fact is, there have been many moments in the McCann investigation when there was “BREAKING NEWS” of one form or another. Blogging about the case slacked here at CrimeBlog.US in part because of this — entries would be half-written only to discover that a sighting of the missing girl was false, or that a new suspect was no longer a suspect.

Discussion of the McCann disappearance continued in comments left on blog posts, though. It was clear that many readers were daily seeking some new development, some sign that the little girl with the teardrop eye might one day come home again. Even as British posters gave the McCanns the benefit of the doubt and Portuguese readers seemed more and more cynical, suspicious of the situation, this hope for Madeleine still seemed to be one point on which the two views agreed.

This desire to find that hope inside this story brings up another spectre raised by heavy suspicion falling on Madeleine’s parents. Implied in allegations of new forensic evidence and naming Gerry and Kate suspects is a terrible conclusion — Portuguese authorities believe the child is dead, and that she may have been dead since May 3, 2007. If the McCanns being named ’suspects’ can be called a shocking development, this is the core reason for the shock. While there was a possibility that Madeleine had been abducted by a stranger, there existed a glimmer of hope that she might still be alive.

The possibility that both parents had a hand in her disappearance suggests strongly that Madeleine is long gone, and may never be found.

Even new suspicion directed at Madeleine’s parents may prove unfounded, in the end. Gerry and Kate, in that case, will have been through more hell than most parents could ever imagine.

Mystery in Nevada: The Murder of Judy Calder

When Judy Conger Calder, age 64, vanished from Reno, Nevada on August 18, her family knew right away that something was wrong. Judy had high blood pressure and diabetes. She couldn't go long without her medication.

Judy's family was right to worry.

Calder was found in remote Elko County NV last week. The associate professor in the human development and family studies department at the University of Nevada, Reno, had been dead since her disappearance two weeks ago. She was stabbed to death.

Now authorities in Sparks, NV are gearing up to issue a warrant for the mystery man suspected of murdering Judy Calder, a business associate of the victim and her husband James, one "Ricky Barge."

Ricky Barge isn't his real name.

Police think that the man who calls himself "Ricky Barge" murdered Judy Calder the day she disappeared. They also believe the murder took place at a business the 50-year-old Mr. Barge co-owns with another person.

Following the murder someone took Judy Calder's body to Elko County and left it along a stretch of U.S. Highway 93.

Detectives from the Sparks Police Department believe they have strong information about Barge's alleged role in Calder's disappearance. No one is saying much about motive at the moment.

James and Judy Calder had regular communication with with Ricky Barge relating to Imaging Technologies, a business located at 335 Edison Way in Reno.

Investigators still aren't clear on who Ricky Barge may actually be. They are working with Immigration and Customs Enforcement to determine Barge's whereabouts. His immigration status is not known.

It isn't referenced in recent articles about the investigation into Judy Calder's murder, but at one time, James Calder was actually co-owner of Imaging Technologies. At least, the Better Business Bureau thought he was. Imaging Technologies, according to the BBB listing was owned by Ms. Rose Ayube and Mr. J. Calder. The Nevada Corporations database listed the Calders (Judy and husband James) as owners of Calder, Conger & Associates, Inc. Judy was also listed as a director for Digital Matrix Software Solutions, and James as treasurer for Bridgestreet Nevada, Inc. If either James or Judy Calder had been co-owners of the business at Edison Way, it was not easy to find that connection in the corporations database.

The name of the proprietor for the business listed on the BBB web page, Rose Ayube, didn't turn up either in the state database, or in any other searches

At least not the first name, Rose. The last name, "Ayube," did come up, and in association with Imaging Technologies. Even though all news reports have listed the street address for Imaging Technologies as 335 Edison Way in Reno, a Google Map search returned a different address: 105 N. Edison Way, #10. This was probably a former address for the business. However, at one time, someone listed it as their permanent address.

A 40-year-old Hai U. Ayube was recorded as living at that address in 2003. Linked to the name Hai Ayube was Maharul Ayube.

One address for Maharul A. Ayube was 10860 Rushing Flume Drive in Reno. On September 3, that address showed up on the Reno Craig's List (screen capture of the Craig's List post, since it will likely be removed). The 4 bedroom, 3 bath home was selling for $475,000, fully furnished.

A look at property data for the Rushing Flume address showed that its value had been assessed at $490,000. The owner of record, Maharul A. M. Ayube, had a familiar mailing address: 335 Edison Way, Ste 6 -- the current address of Imaging Technologies.

A house being sold furnished, for a $15,000 loss. The owner's addresses connected with the same business where Sparks police believe Judy Calder was murdered. The question becomes obvious: is Ricky Barge's real last name Ayube?

If it is, it still won't answer other questions. Where, exactly, did he come from, and why was he using the fake name in the first place?

What could have prompted him to kill Judy Calder, if the charges against him hold true?

As of early Tuesday morning, there was no word of "Barge" being in police custody. That leaves at least one more question -- has he left the country? If he was clever enough to hide behind the "Ricky Barge" moniker for some time, he might have been clever enough to make it out of the U.S. before authorities really began to focus on him as their primary suspect.

Meanwhile, an online memorial has been set up for Judy Calder. There, friends and loved ones are leaving messages of mourning and remembrance. One friend, Jeanne, expressed her feelings simply: "We love you and miss you terribly. You have been a special friend and we will hold you in our hearts forever."

(Alleged) Creep of the Week: Tony Guerra

Tony Guerra, 6'5" and 21 years old, was arrested on August 30, 2007 as he left his food services job in Orange County, Florida. Guerra, who'd allegedly been seeking "hardcore videos involving babies" on the Web, worked for Disney-MGM Studios.

Guerra had been working for Disney for at least a year.

No intrepid American cop with mad chatroom skills discovered the slack-jawed creepiness that is Tony Guerra. The honor of snagging this alleged sicko went to an undercover Australian law enforcement officer who ran into Guerra in a chatroom, where Guerra allegedly stated at one point that he "loved babies."

Tony Guerra's charm didn't stop with expressing his love of infants. He also allegedly sent more than 60 photos to the Aussie cop. Guerra topped that off with four videos of 'baby pornography.'

Agents from the FBI's Innocent Images Task Force arrested Guerra on Thursday the 30th. Guerra's computer, seized from the Kissimmee apartment where he's lived for the last 3 months, allegedly yielded up to 5000 more images of child porn.

Research into Tony Guerra's footprints across the Web suggested that once the authorities knew they were dealing with someone who loved babies in all the wrong ways, finding out more about the guy was probably like shooting fish in a barrel. Tony Guerra had numerous online profiles with related screen names. He frequently gave his real first name and stated his location.

At his "heretictalon" profile, Guerra greeted visitors with "Ogenki desu ka," the Japanese phrase for "how are you?" In the "About me" section he was to the point: "My name is Tony i work at disney im 21 years old."

Given what Guerra has been accused of doing, his interests in books and his "heroes" were nauseating to read. Emphasis has been added to the nauseating parts:

[Heroes] Foremost Jesus, My Bro Brandon who Just came back a couple ah [sic] months ago from iraq. . .
Guerra posted more than 500 times at an online forum, HideoutHeretics.net. There, he went by the screen name Talon.

Guerra's Yahoo ID was published in his HideoutHeretics user profile. That led to his Yahoo profile page:

A hint at Guerra's (allegedly) sick inner life was found on that page. There wasn't much info, but under 'nickname,' Guerra posted '12yroldgirl.'

At the very least, a truly odd choice of handle for a 6'5" white male in his twenties. It was not the only time Guerra alluded to giving himself a different age online, either.

At http://www.stickam.com/profile/heretictalon, Guerra posted a profile containing much of the same info found in his heretictalon MySpace (location, band preference), but he gave his age as 16.

Even as Guerra kept a MySpace where he claimed that his hero was Jesus, someone using the screen name "talonfei," a variation on Guerra's Yahoo moniker, was leaving comments on photos and videos at an Adult video site -- a kind of 'YouTube' for porno. Though there seemed to be a pattern of Guerra showing attraction towards things Japanese in other incarnations (some screen names he appeared to use: "Geki Blue;" "Bouken Silver") including Japanese girls, all the "talonfei" comments left on this video site were for adult males who apparently posted videos of themselves masturbating. These were only preserved in Google's cache, indicating that if this "talonfei" was Tony Guerra, he had at some point deleted his user profile.

It was hard to miss Guerra's job choice -- working in any capacity for MGM/Disney. He was bound to come into contact with more than the normal number of children encountered by adults who don't work in the school system. With his baby face, Tony Guerra might have been an outwardly non-threatening presence.

If Guerra did distribute and own child porn he acquired elsewhere, was he escalating towards making his own? Some of his easily-discovered online presence revealed potentially troubling quirks, but nothing that would truly alarm most people. Only the fact that Tony Guerra has been arrested for distributing kiddie porn that allegedly contained infants rendered what he'd left behind on social networking sites even spookier than it would have normally been.

Authorities in Florida seem sure that they've arrested a particularly odious breed of child pornographer, but Tony Guerra will likely have his day in court, and found either innocent or guilty by a jury of his peers.

Until Guerra has that reckoning he will remain only the "alleged" creep of the week.

Still, it wouldn't be a bad idea at this juncture to inform Tony that when his "hero" Jesus said to "suffer the little children," the Savior wasn't talking about the recorded evils Tony Guerra allegedly purveyed and enjoyed.
